Draft awaiting legal review

This text is a working draft. A law firm is reviewing it and it may change before launch.

1. Who runs this website

Information required by article 10 of Spanish Law 34/2002 on information society services and e-commerce (LSSI):

  • Company name: Vínculo Salud Digital, S.L. (being incorporated).
  • Tax ID (NIF): [pending: NIF].
  • Registered office: [pending: registered office], Madrid (Spain).
  • Registration details: Madrid Companies Registry, [pending: registration details].
  • Email: hola@vinculo.app.
  • Website: https://vinculo.app and the Vínculo mobile apps.
  • Administrative authorisations: Vínculo’s role as an intermediary does not require a healthcare authorisation, because it is not a healthcare centre (section 3). [pending: confirm with a lawyer — opinion on the pure-intermediary model.]
  • Codes of conduct: [pending: state whether Vínculo adheres to any.]

2. What the website is for

Vínculo offers two services:

  • A marketplace where people look for verified health psychologists, read their profiles, message them, and book and pay for sessions online or in person.
  • Practice management software for self-employed psychologists: diary, payments, video sessions, clinical records, consent forms, invoicing on their behalf and tax tools.

Use of the services is governed by the Terms and conditions for patients and the Terms for professionals. How we handle personal data is explained in the Privacy policy and the Cookie policy.

3. Vínculo does not provide healthcare

Vínculo is an information society service provider (LSSI) and an online platform within the meaning of Regulation (EU) 2022/2065, the Digital Services Act. It does not provide healthcare services, is not a healthcare centre, does not employ the professionals and does not assign therapists.

Each psychologist contracts directly with their patient, sets their own price and approach, practises from a practice authorised by their regional government and is responsible for the care they provide and for the clinical record. The information on this website is general and is no substitute for an assessment by a professional.

4. Information about the professionals

Each health professional’s profile shows the information required by article 10.1.d of the LSSI and article 6 of Royal Decree 1277/2003:

  • Full name.
  • Qualifying degree: Master’s in General Health Psychology, the Clinical Psychology specialty (PIR) or a recognised qualification and, where applicable, the country that issued the degree and its recognition in Spain.
  • Professional association (Colegio) and membership number.
  • Healthcare registration number of the practice, granted by the regional government.
  • Applicable professional rules: the Psychologists’ Code of Ethics, published by the General Council of Psychology at cop.es.

Vínculo checks this information before publishing a profile and regularly afterwards, and shows the date of the last check. Each professional is responsible for keeping it accurate and up to date.

5. Terms for using the website

Anyone using the website agrees to do so lawfully and in good faith. In particular, you may not:

  • impersonate anyone else or claim a qualification or professional membership you do not hold;
  • publish content that is illegal, misleading or infringes other people’s rights;
  • extract data in bulk or by automated means without permission;
  • introduce malware or attack the security of the service.

Vínculo may suspend accounts and remove content that breaks these rules, explaining why.

6. Intellectual and industrial property

The brand, design, text and code of the website belong to Vínculo or its licensors and are protected by the Spanish Intellectual Property Act (Royal Legislative Decree 1/1996) and Trade Marks Act 17/2001. They may not be copied or adapted without permission, except for personal use.

Each professional’s text, photos and videos remain theirs; Vínculo only receives the licence it needs to display them.

7. Responsibility for third-party content

Profiles, services, messages and other content from professionals and users are the responsibility of whoever publishes them. As a hosting provider, Vínculo is not liable for them unless it has actual knowledge that they are illegal; if it does, it will act diligently to remove them (article 16 of the LSSI and article 6 of Regulation (EU) 2022/2065). The same applies to links to third-party websites (article 17 of the LSSI).

Vínculo aims to keep the service available at all times but cannot guarantee there will be no interruptions for maintenance or for reasons beyond its control.

8. Reporting illegal content

Anyone can report content they believe is illegal, such as a profile without a healthcare qualification (possible unlicensed practice, article 403 of the Spanish Criminal Code), false credentials, misleading health advertising or personal data published without permission. There are two ways:

  • the Report button on every profile, service or conversation;
  • an email to legal@vinculo.app.

The report must include what article 16.2 of Regulation (EU) 2022/2065 requires:

  1. an explanation of why the content is illegal;
  2. the exact web address of the content;
  3. the name and email address of the person reporting;
  4. a statement of good faith that the information is accurate.

Vínculo will acknowledge receipt, decide diligently and objectively, and send a reasoned decision to the people affected, who may challenge it (article 17). If it suspects a crime that threatens someone’s life or safety, it will inform the authorities (article 18).

legal@vinculo.app is also the single point of contact for authorities and users (articles 11 and 12), in Spanish and English.

9. This is not an emergency service

Vínculo is not an emergency service. If you or someone else is in danger, call 112. If you are having thoughts of suicide, call 024, free and available 24 hours a day. More resources under Urgent help.

10. Governing law and jurisdiction

This legal notice is governed by Spanish law. If the user is a consumer, the courts of their place of residence have jurisdiction (article 90.2 of the Spanish Consumer Protection Act and article 18 of Regulation (EU) 1215/2012). In all other cases, the courts of Madrid. [pending: confirm with a lawyer — jurisdiction for professionals and the effect of the out-of-court dispute resolution requirements of Organic Law 1/2025.]
